* Says litigation settled for $48 million
* Says will reimburse $5.5 million of costs to GGP/Homart II jv partner
* Says settlement will increase funds from operations by $0.16 per diluted
earnings per share
* Says settlement will result in increase in earnings per share of about
$0.19
for Q4 2008
